Terms of Service

1. Copyright & Image Usage

All images created by the Photographer are protected under the Copyright Act 1968 (CTH) and remain the exclusive property of the Photographer.

Upon full payment, the Client receives a non-exclusive, non-transferable license to use the final edited images for personal or agreed commercial purposes such as social media, websites, or marketing materials.

Clients may not sell, edit, or license images to third parties without written consent from the Photographer.

The Photographer retains the right to use any images for portfolio display, social media, publications, and marketing, unless the Client requests in writing not to have their images used for promotional purposes before the session.

RAW or unedited files are not provided and remain the Photographer’s property.

2. Cancellations & Rescheduling

A non-refundable deposit of 10% is required to secure your booking. Your date is not confirmed until this deposit and written confirmation are received.

If the Client cancels:

  • More than 7 days before the scheduled session: The deposit is forfeited, but no further payment is required.

  • Within 3 days of the session: The full session fee will still be due.

Rescheduling is allowed once, provided it’s requested at least 7 days in advance and the Photographer is available. Deposits can be transferred to the new date within 1 month.

If the Photographer must cancel due to illness, emergency, or unforeseen circumstances, all payments (including the deposit) will be refunded in full — this is the limit of our liability.

3. Liability & Limitations

The Photographer will take every reasonable measure to ensure the safe handling and delivery of your images. However, in the rare event of equipment failure, data loss, accident, illness, or other circumstances beyond our control, our total liability is limited to the return of all payments received.

We are not responsible for:

  • Unsatisfactory results due to circumstances beyond our control (e.g., client lateness, weather, venue restrictions, or lack of cooperation).

  • Loss or damage arising from the Client’s use or distribution of the images.

  • Any claims by third parties related to the use of the images.

The Client is responsible for obtaining all necessary permissions to photograph at chosen locations and ensuring the safety of participants during the shoot.

4. Indemnification

The Client agrees to indemnify and hold harmless the Photographer from any claims, damages, or expenses (including legal fees) resulting from the Client’s misuse of the images or breach of these Terms.
